By accessing or using the Consequence Forum website located at https://consequenceforum.org/ (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not access or use the Site.

These Terms apply to all visitors, users, and others who access or use the Site. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. Use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

Consequence Forum is a nonprofit creative online platform dedicated to thoughtful public discourse, commentary, and analysis on topics including but not limited to culture, politics, media, and society. The Site provides:

•       Articles, essays, and editorial content authored by contributors
•       Commentary and analysis on current events and cultural topics
•       User-generated content including comments and discussions
•       Newsletters, podcasts, and multimedia content
•       Community features enabling registered users to engage with content

3. User Accounts and Registration

3.1 Account Creation

Certain features of the Site may require you to register for an account. When you register, you agree to provide accurate, current, and complete information and to update this information to keep it accurate.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. Consequence Forum will not be liable for any loss or damage arising from your failure to maintain the security of your account.

3.3 Age Requirements

You must be at least 13 years of age to use the Site. If you are under the age of 18, you must have parental or guardian consent to use the Site. By using the Site, you represent that you meet these age requirements.

4. User Conduct and Community Guidelines

We are committed to fostering respectful, thoughtful, and constructive discourse. While we support diverse viewpoints, users are expected to engage in good faith. Content moderation decisions are made to protect the integrity of the platform, its contributors, and its community. You agree that you will not use the Site to:

•       Post, transmit, or share content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable
•       Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
•       Engage in any form of targeted harassment, hate speech, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
•       Violate the intellectual property rights of Consequence Forum or any third party
•       Post spam, unsolicited advertising, or promotional materials
•       Introduce malware, viruses, or any harmful code into the Site
•       Attempt to gain unauthorized access to any portion of the Site or its related systems
•       Scrape, crawl, or systematically collect data from the Site without our express written permission
•       Use automated bots or scripts to interact with the Site in a manner that disrupts normal operations

We reserve the right to remove content and terminate accounts that violate these guidelines, at our sole discretion. We may take a range of actions in response to violations, including content removal, warnings, temporary suspension, or permanent account termination, depending on the severity and frequency of the violation. 

5. Intellectual Property

5.1 Ownership of Content

All content on the Site, including without limitation text, graphics, logos, images, audio, video, and software, is the property of Consequence Forum or its content suppliers and is protected by applicable intellectual property laws.

5.2 Limited License

Consequence Forum grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Site without our express written consent.

5.3 User-Submitted Content

By submitting content to the Site (including comments and discussion posts), you grant Consequence Forum a worldwide ,non-exclusive license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of operating, improving, and promoting the Site and its mission. .

You represent and warrant that you own or have the necessary rights to the content you submit and that such content does not infringe any third-party rights.

6. Third-Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by Consequence Forum. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites. We strongly advise you to review the terms and privacy policy of any third-party site you visit. Content on the Site may include material generated or assisted by artificial intelligence tools. While we strive for accuracy and integrity, we do not guarantee the completeness, reliability, or accuracy of such content. Users are encouraged to exercise independent judgment. 

7. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Consequence Forum does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. The opinions expressed by contributors on the Site are their own and do not necessarily reflect the views of Consequence Forum. Inclusion of third-party links does not imply endorsement by Consequence Forum. 

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CONSEQUENCE FORUM, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claims arising from your use of the Site shall not exceed one hundred US dollars ($100.00) or the amount you paid to us in the twelve (12) months prior to the event giving rise to the claim, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Consequence Forum and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.

10. Termination

We reserve the right to suspend or terminate your access to the Site at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of the Site.

Upon termination, your right to use the Site will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability. We may use information associated with user activity to detect abuse, enforce these Terms, and maintain the security and integrity of the Site. 

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Site shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association.

12. DMCA / Copyright Policy

Consequence Forum respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that your copyrighted work has been used on our Site in a manner that constitutes copyright infringement, please send a written notice to our designated agent at info@consequenceforum.org including the following information:

•       A description of the copyrighted work claimed to have been infringed
•       A description of where the allegedly infringing material is located on the Site
•       Your contact information
•       A statement that you have a good-faith belief that the use is not authorized
•       A statement, under penalty of perjury, that the information in your notice is accurate
•       Your electronic or physical signature

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Site after any changes indicates your acceptance of the new Terms.
